Governing Law—Disputes

Any order placed with Point Energie by any means whatsoever implies unconditional acceptance of these general terms and conditions of sale. It is the responsibility of each customer, whether a business or an individual, to review Point Energie’s general terms and conditions of sale before placing an order. Orders are subject to French law.

Contractual information is provided in French, and the products offered for sale comply with French regulations. Where applicable, it is the responsibility of the international customer to verify with local authorities whether the product they intend to order may be used; Point Energie shall not be held liable in the event of non-compliance with the regulations of a foreign country to which the product is delivered.

In the event of a dispute, the French courts shall have exclusive jurisdiction. In the event of a dispute between Point Energie and any other company, the courts of the judicial district of Nice shall have exclusive jurisdiction.

Point Energie shall not be held liable for any errors that may have crept in. All text and images presented on the website are protected worldwide by copyright and intellectual property rights; their reproduction, even in part, is strictly prohibited without the express consent of Point Energie.

Similarly, the creation of any hyperlinks to the website without the express authorization of the company’s legal representative is strictly prohibited.

- Duration and Validity of Sales Offers:
Products are offered for sale while supplies last. If a customer orders a product that is no longer available, the customer will be notified of this as soon as possible by email, fax, or mail.


Product Prices

The prices listed in the catalog are in euros and include all taxes, based on the applicable VAT rate on the date of the order (excluding reseller access); any change in the tax rate may be reflected in the price of the products or services.

The prices and products offered by SARL Point Energie are subject to change on a weekly basis; however, the price listed in the catalog on the day the order is placed will be the only price applicable to the buyer.
The prices listed include order processing and shipping costs, provided that the orders are placed within the geographic areas specified below.

The prices listed on the website do not apply to the brand's various stores under any circumstances.


Geographic area:

Online sales of the products and services featured on this website are limited to buyers residing in France and Monaco, throughout Europe, and in the French overseas departments and territories (DOM-TOM), and are for deliveries to these geographic areas. Shipping costs vary depending on the weight of the products ordered and the delivery location. They are calculated automatically when you check out.

* Free shipping on orders of €150 or more, as mentioned at the top of the home page, is available only in France

Order

The customer accepts the terms and conditions of sale at the time of selecting a payment method.

The customer thereby accepts the ordering process and these general terms and conditions of sale. Point Energie confirms the order by email; this confirmation includes all the details of the order.

Point Energie sends a second email on the day of shipment to notify the buyer. The data recorded by Point Energie constitutes proof of the nature, content, and date of the order.
This information is archived by Point Energie; the customer can access this archive by contacting Customer Service via email. Regarding fax orders placed by businesses, only pro forma invoices or quotes from Point Energie that are duly signed by a legal representative and bear the notation “Agreed, read, and approved” along with the client company’s stamp will be accepted.


Payment

Payment is due at the time of order.

Payments will be made:

  • Or by credit card; payments will be processed through Crédit Mutuel’s secure system, ensuring that the information transmitted is encrypted by software and that no third party can access it while it is in transit over the network. Point Energie does not receive a copy of the credit card number used; this information remains confidential between the customer and Crédit Du Nord.
  • Or by check, which should be included with the order form available for download on our website. A photocopy of your ID is required for shipment of the goods. To ensure the availability of your order before we receive your check, Point Energie strongly recommends that you make a reservation by email after placing your order. This system will allow us to prepare your order while we await receipt of your payment.
  • Or by bank transfer. Once we receive your payment, we will ship the equipment to you.

Point Energie will not consider the order confirmed by the customer to be effective until the relevant bank payment centers have given their approval

If the aforementioned centers refuse the order, it will be automatically canceled, and the customer will be notified by phone, mail, or email.
All orders will be confirmed by return email.
Furthermore, Point Energie reserves the right to refuse any order from a customer with whom there is an outstanding dispute.
A paper invoice showing the VAT will be sent to the buyer in all cases.


Delivery

Products available in our inventory are shipped (barring unforeseen circumstances related to third-party shipping):

  • within at least two business days for mainland France
  • based on the standard shipping time for other countries in the eurozone (as well as for Corsica, the French overseas departments and territories, Switzerland, and the United Kingdom), effective as of:
    - the order date for credit card payments made before 4:00 p.m.
    - receipt of payment by Point Energie in the case of payment by check or bank transfer.

The buyer bears the risks associated with shipping. In the event of damage and/or missing items discovered upon receipt, the buyer must file all customary claims with the carrier and notify Point Energie’s Customer Service within 24 hours by:

The buyer is responsible for the cost of returning the package. A fee to cover administrative costs will be charged in the following cases:

  • Any package that has been shipped, has not been claimed by the buyer, and has been returned by the carrier to Point Energie may be reshipped at the buyer’s expense.
  • Any package that is reshipped due to incorrect delivery information or an order error attributable to the buyer may be reshipped at the buyer's expense. 
  • International shipments made by Delivengo (outside of France) are at the buyer's own risk; no refunds or compensation will be provided.

If delivery is not made within thirty days of the order date, the customer will be notified as soon as possible, by email, fax, or mail, that delivery is not possible.

The order would then be considered canceled, and any payments made by any means would be refunded by check in euros within a maximum of thirty days.


Force Majeure

Under no circumstances shall Point Energie be held liable for any breach of its contractual obligations in the event of force majeure arising from the following events, which are not intended to be an exhaustive list: internal or external strikes, disasters, delays in our supply, and, in general, any event that affects and renders impossible the normal fulfillment of orders.

Warranty Terms and Conditions

General Terms and Conditions Regarding the Warranty for Consumer Products (for the European Union)

All consumer products are guaranteed against defects in workmanship or materials as of the date of actual purchase; if the complaint is justified and the repair or replacement of an item is deemed impossible, or if the costs are deemed disproportionate, Point Energie reserves the right to replace the item with an equivalent item or to refund all or part of the purchase price. In such cases, you will be provided with a replacement item or a full refund of the purchase price if a defect occurs within 1 year of purchase and delivery, or a replacement item for 50% of the purchase price or a refund of 50% of the purchase price if a defect occurs between 1 and 2 years after purchase and delivery.

All starter batteries for motorcycles, scooters, jet skis, ATVs, etc., come with a 6-month warranty, and the buyer is responsible for return shipping costs.

The following are therefore excluded:

  • Any direct or indirect damage to the item occurring after delivery (e.g., damage caused by oxidation, impact, dropping, dust, sand, impurities, etc.) and caused by the device, as well as damage to its contents (e.g., data loss) and any compensation for loss of income;
  • Any consumer good, accessory, or part that requires regular replacement, such as batteries, light bulbs, rubber parts, belts, etc. (the list is endless);
  • Any damage resulting from a fire, lightning, an accident, a natural disaster, etc.;
  • Any damage caused by negligence—whether intentional or unintentional—improper use or maintenance, or use of the device in a manner contrary to the manufacturer’s instructions;
  • Any damage resulting from commercial, professional, or collective use of the device (the warranty period will be reduced to 6 months in the case of professional use);
  • Any damage to the device resulting from improper use or use other than that for which it was originally intended, as described in the instruction manual;
  • Any damage caused by returning the device in packaging that is not protective or is insufficiently protective.
  • Any repair or modification performed by a third party without the express authorization of Point Energie;
  • Shipping costs to and from Point Energie if the appliance is no longer covered by the warranty.
  • All repairs will be performed by the place of purchase. The device must be accompanied by the original receipt and properly packaged (preferably in the original packaging with a note describing the defect);
  • Tip: Read the instruction manual and check the cables, batteries, etc., before returning the device. If a returned device is deemed defective but is found to be in good working order, the consumer may be charged for the repair;
  • Any repair performed outside the warranty period will be subject to
  • Shipping costs;
  • Any commercial warranty does not affect the terms and conditions set forth above.

For professional use:

Devices used on an almost daily basis for profit or any other commercial benefit fall under the category of “professional use” and include devices used regularly in the hotel, restaurant, and café sectors, commercial businesses, nightclubs, etc. Due to their frequent use, which leads to premature wear and tear, the warranty period is reduced to 6 months. No commercial warranty shall affect the above-mentioned conditions.

Right of Withdrawal

Only individual customers have fourteen calendar days (if the fourteenth day falls on a Saturday, Sunday, or public holiday, the period is extended to the next business day) from the date of delivery to return the product; the customer is responsible for return shipping costs.
The customer will then be refunded the price of the product within a maximum of thirty days from the date the product is returned to the Point Energie premises.
However, products returned incomplete, damaged, or defective due to mishandling will not be accepted for return or exchange.

The customer must first request authorization from Customer Service to return an order before sending it back.

The customer will be charged a restocking fee ranging from €4 to €8 per item, depending on the item.

We process orders with the utmost care to ensure prompt shipping. However, please note that if you request to cancel an order after it has been placed, our team may not be able to process your request before the order is shipped.
Please note that if an order has already been shipped before your cancellation request is processed, the buyer will be responsible for return shipping costs.


Data Privacy

Personal data provided by the customer is not disclosed to third parties; unless the customer expressly objects, it is added to Point Energie’s customer database.
